    Law on State Fees

    GENERAL
    Art. 1. (Amended - SG. 55 of 1991, amend. - SG. 100 of 1996) (1) The fees collected by the judicial bodies, other state authorities and budget organizations in size, certain tariffs approved by the Council of Ministers, and act in the state budget, unless the law provides otherwise.

    (2) The Council of Ministers may determine the state fees in foreign currency when they meet abroad or from foreign persons crossing the Bulgarian border.

    Art. 2. (1) The charges are simple and proportionate. They are paid by state tax stamps or cash. Minister of Finance determines how revenue stamps are destroyed and in which cases the fees are collected in cash.

    (2) (Amended - SG. 55 of 1991, amend. - SG. 82 of 1997, suppl. - SG. 62 of 2002) proportionate fees are determined on the price of document or service. When the price is not specified, the fee is determined on the market price. Simple fees are determined based on the necessary logistics and administrative costs of providing the service.

    Art. 3. (1) (Amended - SG. 100 of 1996, amend. - SG. 62, 2002) The state fee is payable upon lodgement of the request for the operation and / or issuance of the document for which the fee is paid as specified in the tariff.

    (2) Extra charge for documents in which the price is established later, is carried out within 14 days of establishing her

    Art. 4. Stamp duty payable:

    a) (amended - SG. 62 of 2002) for application to civil claims in criminal cases in counterclaims, claims for divorces, complaints, requests for annulment requests for adoption, for registration associations and foundations, in criminal cases from private and other services administered by the courts;

    b) (revoked - SG. 100 of 1996);

    c) (amended - SG. 55 of 1991, amend. - SG. 104 of 1996, amend. - SG. 36 of 2004, with effect from 31.07.2004 on , amend. - SG. 43 of 2005, in force from 01.09.2005) to carry out activities and services of state enforcement and registry offices;

    d) to perform translations of documents and papers from foreign languages into Bulgarian and vice versa;

    e) (amended - SG. 62 of 2002) for the issuance and renewal of identity documents for various granting visas to passports and ship patents to issue laissez-passers and residence permits in the country;

    f) for applications and certificates for the acquisition and restoration of Bulgarian citizenship, for authorizing the acquisition of foreign nationality, as well as applications submitted to the council's nationality;

    g) (amended - SG. 55 of 1991, amend. - SG. 62 of 2002) for actions and issuance of documents relating to fire safety and emergency;

    h) (revoked - SG. 62, 2002)

    i) (amended - Izv., No. 21 of 1960, as amended. - SG. 62 of 2002) for registration of persons who carry out transactions such as currency exchange office, or of persons engaged in business activities associated with mining, processing and transactions with precious metals and precious stones;

    k) (amended - SG. 62 of 2002) for examinations to qualify for the management of vehicles and registration of changes in the enjoyment of the same;

    l) (amended - SG. 81, 1999, in force from 14.12.1999) to issue patents for inventions and utility models, to issue certificates for new plant varieties and animal breeds for registration renewal, transfer and other marks and design registration and other geographical indications and topographies of integrated circuits;

    m) (Amended - SG. 100 of 1996, amend. - SG. 62 of 2002) for review and issuance of permits and to implement actions in financial control in the printing of securities, forms forms and accounts;

    n) (new - SG. 55 of 1991, amend. - SG. 100 of 1996) to participate in competitions at state offices for the issuance of permits and copies of documents in these offices;

    o) (previous letter "n" - SG. 55 of 1991) for applications to the state institutions to carry out activities and services and for issuing documents and duplicates.

    p) (new - SG. 62 of 2002) for checking and marking of gold and silverware, and to quantify the gold and silver articles of precious metals.

    Art. 4a. (New - SG. 53, 1973, ex art. 5a amend. - SG. 55 of 1991, amend. - SG. 100 of 1996) (1) (Suppl. - SG. 87, 1974, repealed. - SG. 62, 2002)

    (2) (revoked - SG. 104 of 1996)

    Art. 4b. (New - SG. 62, 2002) wrongly paid fees shall be returned at the request of the interested party.



    II. EXEMPTION FROM STATE TAXES

    Art. 5. Exempt from payment of state taxes:

    a) (amended - SG. 55 of 1991, amend. - SG. 100 of 1996) requests submitted to the National Assembly to the President of the Republic, to the Council of Ministers;

    b) (amended - SG. 62, 2002) documents and papers on employment of employees under the Protection of Labor and the provisions issued under their administration, and labor contracts - individual and collective;

    c) applicants - employees - claims made for salary and wages, but also on other claims arising from employment contracts;

    d) plaintiffs - members of the producer craft cooperatives - in claims for compensation for work in these cooperatives;

    e) (revoked - SG. 62, 2002)

    f) the plaintiffs - claims for compensation arising from the rights of inventions;

    g) plaintiffs - claims for maintenance;

    h) registration of acts of birth, death and adoption certificates for the initial registration of civil status acts;

    i) (revoked - SG. 55 of 1991)

    k) (amended - SG. 55 of 1991) all documents and papers: criminal cases of a general nature, in matters of maintenance, in matters of guardianship, in cases to establish the origin of the papers and documents setting and giving aid to large parent; on public assistance, for socio-legal protection of minors; acquisition of pension rights, of formation, registration and other changes of cooperatives;

    l) papers and documents relating to activities of mutual funds;

    m) (new - Izv., No. 89, 1959, amend. - Izv., No. 21 of 1960, as amended. - SG. 55 of 1991, amend. - SG. 62 of 2002) all applications, applications, people, certificates and certificates of education and the completion of training courses and any other licenses, certificates and duplicates thereof, issued by schools and educational institutions to obtain primary and secondary education and the Ministry of Education and Science;

    n) (new - SG. 55 of 1991), foreign nationals, adopted under the inter-state treaties and agreements to participate in competitions for higher education in state and semi-higher education institutions;

    o) (new - SG. 55 of 1991, amend. - SG. 100 of 1996) the disabled, pregnant women and mothers with children under 6 years of age, orphans in the case of transfer from one school to another, from one form of specialization or training in other health reasons established by the conclusion of the medical commission;

    p) (new - SG. 87 of 1995) The Bulgarian Red Cross;

    p) (new - SG. 90 of 2002) applications for registration of school boards in the register of county court;

    r) (new - SG. 84 of 2003) cases provided for in international treaties in force for the Republic of Bulgaria.

    s) (new - SG. 18 of 2006) the parties to the proceedings under Art. 14b of the Social Assistance Act.



    III. RESPONSIBILITIES

    Art. 6. Responsible officials and private individuals for their outstanding wines in fees or paid less are required to pay the same and shall be punished by a fine of up to triple size.

    Art. 7. (1) (Amended - SG. 62, 2002, amended. - SG. 33 of 2006) Monitoring of the proper identification and collection of fees shall be held by the heads of relevant government authorities and budgetary organizations and courts. Financial authorities and the Agency for State Financial Inspection shall carry out inspections on the correct assessment and payment of state taxes.

    (2) (Amended - SG. 55 of 1991) Violations shall be established by an act. The offender is given a 7-day period for objections and present evidence. Unfounded objections in a decree issued by the Head of Service, subject to review by the respective order of the Administrative Violations and penalties.

    (3) In the event that the offender pay the fee before issuance of the decree, the fine is collected to 50% discount.



    ADDITIONAL PROVISION

    § 1. (New - SG. 100 of 1996, amend. - SG. 62, 2002, amended. - SG. 37 of 2004, in force on 06.08.2004) Foreign persons "within the meaning of this law are persons under § 1, item 1 of the Law on investment promotion.


    Final Provisions

    § 2. (Suppl. - SG. 100, 1992, suppl. - SG. 69, 1995, ex art. 8 - SG. 100 of 1996, suppl. - SG. 86 since 1997, suppl. - SG. 133 of 1998, suppl. - SG. 97, 2000, in force from 01.01.2002, amend. - SG. 63 of 2002 , amend. - SG. 86 of 2003, suppl. - SG. 24 of 2004, amend. - SG. 43 of 2008) This Act does not affect the fees charged by customs, banks, post offices, telegraph and telephones and state-owned enterprises, and fees charged under the Law on Environmental Protection, Law on Railways, Roads Act, the Safe Use of Nuclear Energy Act, the Waste Management Act for marine areas, inland waterways and ports of Bulgaria and the Protected Areas Act. The amount of fees collected from state enterprises is determined by rates approved by the Council of Ministers.

    § 3. (Former art. 9 - SG. 100 of 1996) This law repealed the judicial, office and other duties, taxes and Berry collected the following laws:

    1) Art. 27, 28, 29 and 30 of the Law on notary;

    2) Art. 12, 13, 14 and 15 of the bailiffs;

    3) Art. 27 of the Law on State Arbitration;

    4) Art. 21 and 22 of the Bulgarian Citizenship Act;

    5) Art. 55, paragraphs 9, 11 and 12 of the Law on fire protection;

    6) Art. 1, 2, 6 and 8 of the school, a boarding and examination fees at the Institute for children and teachers at the Institute for primary teachers;

    7) Ordinance - a law amending the letter "b" to art. 4 of the Fund Medical buildings;

    8) Art. 4, 15 and 18 of the Law on Hunting;

    9) Art. 25 of the Law on measures and measuring instruments;

    10) all laws and texts that contradict it.


    This Act shall enter into force on January 1, 1952

    TO THE LAW AMENDING CODE OF CIVIL PROCEDURE

    (PROM. - SG. 84 of 2003)


    § 18. This Act shall enter into force on the day of publication in the Official Gazette of the European Convention on Recognition and Enforcement of decisions on custody and restore custody since 1980, according to the Hague Convention on Civil Aspects of International Child Abduction since 1980, with the exception of § 2, 3, 4, 5, § 8 - in the section on art. 423a, para. 1, § 12, 15, 16 and 17 and § 10 shall take effect from the date of entry into force of the Law amending and supplementing the Code of Civil Procedure (State Gazette. 105 of 2002).
